Privacy Policy

1. Who we are

Arkyvus LLC (“Arkyvus,” “we,” “us,” or “our”) operates the Arkyvus brand enforcement and marketing operations platform and the public website at arkyvus.com and related domains (collectively, the “Service”). This Privacy Policy explains how we collect, use, share, and protect information when you visit our marketing site, request a working session, create an account, or use the product.

2. Information we collect

Account and contact information

When you create an account, request a session, or otherwise contact us, we may collect:

  • Name and work email address
  • Organization / company name and role
  • Password (stored using industry-standard hashing; we never store plain-text passwords)
  • Profile and billing details you choose to provide

Usage and device information

We automatically collect technical and usage data, such as:

  • Log data (IP address, browser type, pages or API routes visited, timestamps)
  • Device and client identifiers needed for security and session management
  • Product usage patterns, performance metrics, and error diagnostics

Customer content

To provide brand enforcement, review, and deployment workflows, we process content you or your organization upload or create in the Service, which may include:

  • Marketing copy, creative assets, and media
  • Brand kits, guidelines, scores, and related metadata
  • Campaign, project, review, and approval records
  • Comments, assignments, and workflow history

Customer content is processed under the instructions of the customer organization that controls the workspace (tenant isolation / query context). We do not sell customer content.

3. How we use information

We use the information we collect to:

  • Provide, maintain, secure, and improve the Service
  • Authenticate users, enforce access controls, and prevent abuse
  • Operate governed review, scoring, and deployment workflows
  • Process working-session requests and customer support inquiries
  • Send service notices (security, billing, material product or policy changes)
  • Analyze aggregated usage to improve reliability and product quality
  • Comply with law and enforce our Terms of Use

4. AI-assisted processing

Arkyvus uses artificial intelligence to assist humans with brand analysis, scoring, recommendations, and related workflows. “AI assists. Humans decide.” In practice this may include:

  • Generating embeddings or similarity scores for brand alignment
  • Summarizing or recommending edits for human review
  • Routing or prioritizing review signals for people to resolve

AI output is assistive. Final creative and compliance decisions remain with authorized human users. We do not use one customer’s private workspace content to train models for other customers’ benefit without a separate, documented agreement.

5. When we share information

We do not sell or rent personal information. We may share information only:

  • With your organization: Workspace admins and authorized users may see content and activity within their tenant scope
  • With service providers: Hosting, email, analytics, payment, or AI infrastructure vendors under contractual confidentiality and processing limits
  • For legal reasons: When required by law, valid legal process, or to protect rights, safety, and integrity of the Service
  • Business transfers: In connection with a merger, acquisition, or asset sale, subject to continued protection of personal data
  • With consent: When you or your organization explicitly authorize sharing

6. Cookies and similar technologies

We use cookies and similar technologies to maintain sessions, remember preferences, improve security, and understand how the marketing site and product are used. You can control cookies through browser settings; some features may not work if essential cookies are disabled.

7. Data security

We implement administrative, technical, and organizational measures appropriate to the risk, including encryption in transit, access controls, monitoring, and staff practices designed to protect personal and customer data. No method of transmission or storage is perfectly secure; we work to detect and address incidents promptly.

8. Retention

We retain information for as long as your account or organization workspace is active, as needed to provide the Service, as required by law, or as necessary for legitimate business purposes such as security and dispute resolution. When you delete an account or request deletion, we remove or anonymize personal data according to our retention schedule, except where we must keep limited records.

9. Your rights

Depending on your location, you may have rights to access, correct, delete, export, restrict, or object to certain processing of your personal information. To exercise these rights, contact privacy@arkyvus.com. If you use Arkyvus through an employer or agency, some requests may need to go through your organization as the workspace controller.

10. International transfers

We may process information in the United States and other countries where we or our providers operate. Where required, we use appropriate safeguards for cross-border transfers.

11. Children’s privacy

The Service is not directed to children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal information from children.

12. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after the effective date constitutes acceptance of the revised policy where permitted by law.
